Planning for and protecting your young children is a priority in any plan we put in place. We'll help you ensure that your minor children will be taken care of by people you know, love, and trust if something happens to you.
In New Jersey, you must have a will to name a guardian for minor children. Without a will, a guardian will be appointed by the court, and it may not be the person you would choose yourself.
With a will, you can specify exactly who will care for your children and who will be responsible for their finances. You can also include specific instructions and wishes.
Plan ahead for young adult children so that in case of medical emergency, you are legally able to step in and make health care and financial decisions for them if necessary. At age 18, your child is an adult in the eyes of the law. This means that as parents you no longer have the authority to make decisions regarding your adult child's medical care, nor will you have access to their medical records and HIPAA-protected healthcare information.
Similarly, without proper legal authorization, parents also have no access to an adult child's finances in the event the child is unavailable or unable to manage them.
Every adult regardless of age should have, at the very minimum, a living will, a medical power of attorney, a durable financial power of attorney, and a HIPAA release that allows their loved ones to know what they want and to be able to act on their behalf, in case they are unable to do so for themselves.
